JMM points out that Miller's claim that she was just waiting for a 'voluntary' waiver and that Libby finally provided that, is not credible - something that's been clear since her release but was backed up by a Reuters story today which points out that there is really very little to distinguish Libby's earlier waiver from the one Miller received last week considering that both were granted at the behest of the special prosecutor.
So, the question naturally becomes, what made Miller want to sing? Just sick of jail? I doubt it. I suspect the real answer is that Fitzgerald put the squeeze, not only on Libby (who is obviously worried about being indicted and wants the right kind of testimony from Miller for his defense) but also on Miller and her lawyer. I think both parties involved came to realize that if Miller didn't testify, one or both would end up indicted, Libby for leaking Plame's name and or engaging in a conspiracy to cover up the leak and Miller for criminal contempt.
Which leaves the New York Times editorial board and ol' Pinch with zero credibility.
